[{"id":2861,"date":"2021-04-13T14:50:27","date_gmt":"2021-04-13T04:50:27","guid":{"rendered":"https:\/\/www.australianfamilylawyers.com.au\/?post_type=news&amp;p=2861"},"modified":"2021-04-13T14:50:27","modified_gmt":"2021-04-13T04:50:27","slug":"afl-featured-in-national-news-regarding-covid-divorce-rates","status":"publish","type":"news","link":"https:\/\/www.australianfamilylawyers.com.au\/mediation\/news\/afl-featured-in-national-news-regarding-covid-divorce-rates\/","title":{"rendered":"AFL Featured in National News Regarding Covid Divorce Rates"},"content":{"rendered":"<h4>Our Head of Legal for Queensland Vanessa Hernandez was featured in major metropolitan news including the <a href=\"https:\/\/www.google.com.au\/amp\/s\/www.heraldsun.com.au\/news\/national\/splitsville-why-aussies-are-breaking-up-after-covid\/news-story\/f2922ff414262c030ec8f87bfa3ecca8%3famp\">Herald Sun<\/a> and Courier-Mail providing expert legal commentary on family law issues being faced by Australians due to the ongoing impact and pressures of Covid leading to a spike in divorce rates.<\/h4>\n<p>&#8220;Australian Family Lawyers have been taking unprecedented numbers of calls from people enquiring about family law rights, <a href=\"https:\/\/www.australianfamilylawyers.com.au\/legal-services\/separation\" target=\"_blank\" rel=\"noopener\">separation<\/a> and <a href=\"https:\/\/www.australianfamilylawyers.com.au\/legal-services\/divorce\" target=\"_blank\" rel=\"noopener\">divorce<\/a>. Our calls have almost doubled in the last 12 months up 95 per cent on this time last year. We saw a huge spike in calls in July when the national lockdowns ended and another large spike in calls in November mostly from Victorians when the lockdowns there ended,&#8221; she said.<\/p>\n<p>Ms Hernandez added there is also a delay between when people seek information, start separation proceedings and finalise divorce which may see higher divorce rates in coming months.<\/p>\n<p>&#8220;It really has been the perfect storm of financial stress, job losses, loss of social networks and isolation, with work from home creating relationship pressure as well. It also takes 12 months between starting separation proceedings and when the divorce paperwork is officially completed, so we expect to see a rise in the divorce rate later this year,\u2019\u2019 she said.<\/p>\n<p>Covid has also impacted custody arrangements which have required regular negotiation with many children living interstate.<\/p>\n<p>Domestic violence matters which increased through lockdowns were also highlighted by Ms Hernandez as an ongoing challenge.<\/p>\n<p>\u201cDomestic and family violence is a pandemic within the pandemic. Almost half of my cases in Queensland now involve some kind of family violence and this is reflected in all the data we are seeing from domestic violence organisations,\u201d Ms Hernandez said.<\/p>\n<p>\u201cIt\u2019s been very challenging for lawyers to navigate this and at AFL we always advocate for safety first. Now that lockdowns have lifted in most areas there is the opportunity for people to contact lawyers discretely and out of earshot of their partners, again this might mean there are more separations Due to the increased pressure on families during this time, there has been a stark increase in family violence-related enquiries, particularly in the area of <a href=\"https:\/\/www.australianfamilylawyers.com.au\/information-centre\/signs-of-financial-abuse\" target=\"_blank\" rel=\"noopener\">financial abuse<\/a>. Tighter budgets and financial constraints have put further pressure on relationships. Vanessa commented that information is power for victims who found the advice on options for them during this difficult time a huge help.<\/p>\n<p>Also, a large increase in general enquiries regarding family law matters was observed as families suffered under the pressure of lockdown conditions. This same trend was seen post the GFC period with many people putting on hold any decision to divorce\/separate until the period of uncertainty had passed.<\/p>\n<p>Family therapists and lawyers are reportedly booked out due to a spike in inquiries thanks to the COVID-19 lockdowns, particularly in Melbourne and Sydney. are a significant part of any property settlement when filing for divorce, but in Canberra, you might be surprised to hear that your super could be one of your biggest nest-eggs after the family home.<\/p>\n<p>Wages tend to be higher here and with many public servants under generous super schemes it makes sense that residents have one of the highest average superannuation balances per household (<a href=\"https:\/\/www.superannuation.asn.au\/policy\/reports\" target=\"_blank\" rel=\"noopener\">ASFA Research and Resource Centre, 2017<\/a>).<\/p>\n<p>As family law experts, we are finding that the <a href=\"https:\/\/www.australianfamilylawyers.com.au\/information-centre\/need-know-splitting-superannuation\" target=\"_blank\" rel=\"noopener\">super split<\/a> is quite often the centre of <a href=\"https:\/\/www.australianfamilylawyers.com.au\/legal-services\/property-settlement\" target=\"_blank\" rel=\"noopener\">property settlement<\/a> and <a href=\"https:\/\/www.australianfamilylawyers.com.au\/legal-services\/divorce\" target=\"_blank\" rel=\"noopener\">divorce<\/a> disputes here in Canberra.<\/p>\n<p>Another factor that comes into play in the ACT is the on-going \u2018pension for life\u2019 schemes that used to accompany government and military service prior to 2005 and 2016 respectively. Pensions can be treated as a lump sum rather than income and can be included in a settlement.<\/p>\n<p>Many people are also surprised to learn there are time limits on property settlements &#8211; you only have a year from the date your divorce was finalised to file an application to settle your financial situation.<\/p>\n<p>Another trap is thinking that you can divorce straight away but you have organising parenting orders and child support\/spousal maintenance the minute you separate, you don\u2019t have to wait until the divorce is final.<\/p>\n<p>If you miss the deadline for a property social distancing when your kids are divided between two households"},"content":{"rendered":"<p>There is no rulebook for custody during coronavirus. Fear and confusion over how to navigate social distancing and strict hygiene measures have resulted in many separated and divorced parents taking matters into their own hands.<\/p>\n<p>Some parents are restricting or withdrawing access to children, citing concerns that the virus could spread between households. The result is that their former partners have been left out in the cold during what is already an extraordinarily bleak time.<\/p>\n<p>Job losses have created new financial stresses and social isolation has pushed mental health issues to the foreground. For many, it has heightened strains that already existed in relationships and put children at risk.<\/p>\n<p>Relationships Australia has fielded a flood of calls on how to manage child care arrangements during the COVID-19 pandemic.<\/p>\n<p>\u201cIt\u2019s a pretty unprecedented time of stress and anxiety for a lot of people,\u201d says its national executive officer, Nick Tebbey. \u201cAnd when we have families who are separated, or going through the separation process, it\u2019s only adding to what\u2019s already a challenging period for them.<\/p>\n<p>\u201cThere\u2019s the uncertainty of how to navigate the new world order, so people are doing all the right things in terms of wanting to follow the government guidelines and reduce the risk of spread of the virus.<\/p>\n<p>\u201cBut then, when they see that conflicts with, or has the potential to conflict with, their shared custody arrangement or what court orders say, it throws people into uncertainty and challenges them to find the best way to make everyone happy.<\/p>\n<p>\u201cWe are receiving a lot of calls from people right across the country wanting to resolve these sorts of issues. COVID-19 and the added pressure that\u2019s putting on people is one of the first things that\u2019s mentioned in almost all the calls.\u201d<\/p>\n<p>Court orders surrounding shared custody remain in place, but in a March statement the Family Court of Australia acknowledged \u201cthe highly unusual circumstances now faced by Australian parents and carers\u201d making compliance with these orders difficult, and in some cases impossible.<\/p>\n<p>This includes drop-off and pick-up arrangements from schools or extra-curricular activities that are now shut down and transport over state borders, some of which are closed (NSW and Victoria were the only states to keep their borders open).<\/p>\n<p>In all cases, children need to come first, says lawyer Annabel Murray from Australia Family Lawyers. \u201cIt\u2019s a big challenge for children because they\u2019re missing out on the connections with their peer groups and face-to-face time with their friends,\u201d she says.<\/p>\n<p>Murray adds that as well as missing out on time with one of their parents, they\u2019re also losing contact with other members of that parent\u2019s household, such as grandparents and step-siblings.<\/p>\n<p>She also warns parents to be \u201cvery careful\u201d about withholding time with children from an ex-partner. \u201cWhen parents do reach a new arrangement it would certainly be prudent for them to do that in writing so that both of them are very clear about it.\u201d<\/p>\n<h4>&#8216;My ex respects my decision&#8217;<\/h4>\n<p>Perth mum Miyuki Prentice chose to keep her children solely with her.<\/p>\n<p>Miyuki Prentice saw how grave conditions were becoming in mid-March and pulled her two boys, aged six and four, out of school and childcare a week before the government ordered lockdowns. Three days later she lost both her part-time job at Myer and a job offer of full-time work as a travel agent at Flight Centre. While that was a blow, it meant she could spend more time with her children.<\/p>\n<p>\u201cIt\u2019s a lot trickier in our situation, I think because there isn\u2019t anyone to take care of me if I get sick,\u201d she says. \u201cI\u2019m kind of manic about it because it\u2019s bad enough when you get sick with young kids around, let alone with something that might take you out for a couple of weeks.\u201d<\/p>\n<p>Miyuki and her former partner, who didn\u2019t want to be named for this article, have been separated for two years. She has told her ex, who works as a hotel manager and is therefore in an environment where he\u2019s more likely to be exposed, that their usual 80:20 split is unworkable during lockdown restrictions and that the boys are best placed staying with her.<\/p>\n<p>During this time Miyuki\u2019s ex had regular contact with his sons online, but she ruled out physical contact. \u201cI was more worried about him, because they had some cruise ship people, flight attendants and returned Australians staying in the hotel,\u201d she says. \u201cI asked him to keep his distance from the children and he respected that.\u201d<\/p>\n<p>The children returned to weekend visits when WA schools re-opened recently, but Miyuki says the pandemic put a major strain on her relationship with her former partner. \u201cWe\u2019d established a good routine,\u201d she says, \u201cbut coronavirus threw a real spanner in the works.\u201d<\/p>\n<h4>&#8216;We\u2019re spending more time together&#8217;<\/h4>\n<p>Melbourne parents Kish Nilaweera and Lynette Christie considered moving back in together.<\/p>\n<p>Coronavirus may have pushed some split families further apart, but Kish Nilaweera and Lynette Christie have worked hard to strengthen their relationship for the sake of their two sons, aged 10 and six.<\/p>\n<p>\u201cWe\u2019ve got more communication now and we\u2019re spending more time together with the boys,\u201d Kish says. \u201cThe children are still moving between our two houses, but we have spent more time together as a family.\u201d<\/p>\n<p>The pair discussed cohabitation, but decided it would be best for Kish to stay over at Leni\u2019s now and again. Through this arrangement, the parents hoped their two boys would get the best from both parents while waiting to go back to school.<\/p>\n<p>\u201cWe have two very different children and as a single parent it\u2019s hard to entertain them both,\u201d Kish says. \u201cWe initially spoke about it to minimise contact with the outside world, and to give the boys stability.<\/p>\n<blockquote>\n<p>\u201cIt\u2019s down to the parents and their ability to work together. Any parent who says it\u2019s too hard is putting themselves before their children.\u201d<br \/>\nKish Nilaweera<\/p>\n<\/blockquote>\n<p>\u201cAs a trial, we spent a weekend together as a family, which went very well. The arrangement has no impact on child-support obligations, which will remain as they are.\u201d<\/p>\n<p>Flexibility in catering to each other\u2019s work commitments is key to their united approach. \u201cI think child-raising in general is down to the parents and their ability to work together,\u201d Kish says. \u201cAny parent who says it\u2019s too hard is putting themselves before their children. Look for common ground, do not undercut each other, and make sure your children are put first.<\/p>\n<p>\u201cThis is a very uncertain time and our primary concerns are our three monkeys, our dog included, and to make sure they are safe and happy.\u201d<\/p>\n<p>&#8216;We\u2019re talking to each other more&#8217;<br \/>\nMelbourne mum Bree Tollitt tried to keep custody arrangements as normal as possible.<br \/>\n\u00a0<br \/>\nSince they separated two-and-a-half years ago, Bree Tollitt has enjoyed an amicable relationship with her ex-partner. And despite the stress of coronavirus, the two have managed to maintain a stable routine for their eight-year-old son and six-year-old daughter.<\/p>\n<p>\u201cIt is more difficult to see eye to eye on arrangements,\u201d she says. \u201cWe\u2019re both trying to get our heads around it while trying to do what\u2019s best for the kids, and that can lead to stress and heightened anxiety\u201d<\/p>\n<p>The children normally spend 30 to 40 per cent of their time with their dad, who didn\u2019t want to be named for this article. This has dropped slightly because he can no longer take them to weekend sport and after-school activities. However, his flexibility increased when his work as a plasterer ran out in early May.<\/p>\n<p>\u201cThey are still going to their dad\u2019s house every second weekend and for dinner one night a week as per our usual arrangement,\u201d says Bree.<br \/>\n\u00a0<br \/>\n\u201cIf anything we are probably talking to each other a little more than usual due to the situation changing daily and having to discuss how to deal with the changes and what is going to be best for them. I think it is important that they still see both parents and keep some sort of routine.\u201d<\/p>\n<p>When her children are with her, Bree\u2019s toughest challenge is keeping two cooped-up children happy and occupied. The focus of the morning was to encourage each of the attendees to get out there and meet a variety of people, invite them out for a coffee and a 15-minute chat. The aim was to connect with 50 people in a set period &#8211; and so, the \u201850 Coffee Challenge\u2019 was born.<\/p>\n<p>Running on adrenaline, I set myself the task of the \u201950 Coffee Challenge\u2019 and set in motion a plan to connect with 50 experts in their respective fields, to expand my network and develop professional relationships to support my clients and my ongoing growth, as a family law expert.<\/p>\n<p>Within weeks, I had reconnected with old friends, met new professionals, and was captivated by each of their stories, whilst absorbing any bit of advice that I could. We discussed referral opportunities, how we could assist each other in developing our respective practises and simply connected.<\/p>\n<p>As the weeks went by, I was arranging at least two catchups with different professionals each week and I was on track to reach my goal within no time. From psychologists to financial advisors, real estate agents to mediators. The coffee was flowing and the conversations were enlightening. I was beginning to build on these professional relationships and developing my network, through regular catch-ups and social networking events. I had just hit the 30 mark, then came (insert dramatic pause) a global pandemic \u2013 how on Earth was I going to achieve my target in a world of social distancing?<\/p>\n<p>The best way to describe how I felt at that time is represented by that emoji of a hand shown pressing against the head of a person; that\u2019s right, the \u2018facepalm\u2019 emoji. Deflated and in lockdown, I decided that I would give up on my 50 Coffee Challenge, or at the very least place it on hold. Then, during a morning Zoom team meeting, it hit me \u2013 video technology. I could continue my challenge by reconnecting with my network group through various communication platforms, including Microsoft Teams, Zoom, Webex and WhatsApp.<\/p>\n<p>Follow my journey in Shutdown Causing &#8216;Perfect Storm&#8217; For Divorce Lawyers"},"content":{"rendered":"<h4>One family law firm in Australia is reporting a sharp rise in the number of cases, amid fears the coronavirus pandemic will lead to higher divorce rates in the country.<\/h4>\n<p>Courtney Mullen, head of legal at Australian Family Lawyers (AF Legal) in Canberra, said the coronavirus pandemic has created a &#8220;perfect storm&#8221; of stress for families and could be leading to the increased number of cases the firm has seen.<\/p>\n<p>AF Legal said it&#8217;s had a record quarter, with 50 percent more new case openings on the year to date than last year.<\/p>\n<p>The firm recorded its second highest revenue month of the financial year in March, and saw a 48 percent increase in revenue in the three months period up till March 31 than in the prior corresponding period.<\/p>\n<p>Mullen said the Christmas and January period is always a very busy time of year, but believes the devastating bushfires seen across large parts of Australia over summer also placed pressure on families even before the coronavirus hit.<\/p>\n<p>&#8220;We saw it initially I think with the bushfires as well, some really unique cases coming out where you&#8217;ve got the perfect storm of stress. You&#8217;ve got financial stress, emotional stress, and you&#8217;ve got kids who are suffering as a result of that,&#8221; Mullen said.<\/p>\n<p>&#8220;All three of those are definitely present with the current social distancing and isolation.&#8221;<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\" wp-image-793 aligncenter\" src=\"https:\/\/www.australianfamilylawyers.com.au\/wp-content\/uploads\/Courtney-Mullen-website-photo-450x383.jpg\" alt=\"Canberra lawyer, profile photo of Courtney Mullen\" width=\"307\" height=\"261\" \/><\/p>\n<p>Mullen said these factors may also anecdotally be linked to the worrying increase in clients reporting allegations of family violence over the past few months.<\/p>\n<p>AF Legal said almost half (46 percent) of the new cases it took on in March involved some element of family violence. It&#8217;s a sharp rise from January where the number of new cases that had family violence links was 36 percent.<\/p>\n<p>&#8220;We are getting a high percentage of inquiries from families in crisis not being able to escape the stresses that are existing in family dynamics now and having problems with former partners or recently-former partners to leave the house,&#8221; Mullen explained.<\/p>\n<p>&#8220;It&#8217;s a perfect storm of stress for families at the moment I think that has got to be contributing to the increase in allegations of family violence. &#8220;<\/p>\n<h4>Prioritise Your Safety<\/h4>\n<p>Mullen said her first advice to clients in the current environment is to prioritise their safety, including by connecting with support networks and family violence crisis services.<\/p>\n<p>&#8220;My concern is that a lot of people are going to stay and we are going to see an increase in family violence perpetrated,&#8221; she said, adding that some refuges and crisis accommodation services were already seeing immense strain, making it difficult for people to leave their partners.<\/p>\n<p>&#8220;I think the pressure cooker is starting, in terms of some of the inquiries we have been getting in the last couple of weeks we are seeing that spike in allegations of family violence and I think time will tell if the services support people enough to leave of people decide to stay put.&#8221;<\/p>\n<p>&#8220;I think that definitely at the end of this we will see another spike in separations when people actually can be comfortable enough to leave.&#8221;<\/p>\n<p>But not all law firms have seen the same trends. Stephanie Doyle, a partner at Lander &amp; Rogers&#8217; Family and Relationship Law group, said the firm had not noticed an increase in new clients or increased allegations among new clients of family violence since the outbreak started.<\/p>\n<p>But the firm did notice an increase in inquiries from existing clients following the implementation of social isolation measured by the government earlier on in the crisis, Doyle said.<\/p>\n<p>Those clients were seeking advice and reassurance as to how their existing parenting and property matters would be affected by COVID-19, she added.<\/p>\n<h4>&#8216;The reality is there&#8217;s a bit of a lag&#8217;<\/h4>\n<p>Mullen says the real impact on divorce rates in Australia from the pandemic may not be revealed for at least another year.<\/p>\n<p>She said in Australia, a married couple must be separated for 12 months before they can lodge an application for divorce.<\/p>\n<p>&#8220;The reality is there&#8217;s a bit of a lag,&#8221; Mullen explained.<\/p>\n<p>&#8220;I think the feeling among lawyers, or certainly speaking for myself, is we are going to see\u00a0 spike in divorce filings in the coming year or two years as a result of people separating now and not being able to file their divorces later.&#8221;<\/p>\n<p>Mullen said it wouldn&#8217;t be the first time Australia has seen a jump in divorces in the wake of a crisis.<\/p>\n<p>According to the Australian Bureau of Statistics, in 2009, a year after the Global Financial Crisis hit, there was a 4.7 percent rise in the number of divorces granted in Australia compared to the previous year.<\/p>\n<p>It was the first time the number of divorces in the country had increased since 2001, according to the ABS.<\/p>\n<p>A year later in 2010, the number of divorces increased again by 1.6 percent compared to 2009.<\/p>\n<p>Doyle said factors like working from home, home-schooling of children and caring for children without respite could lead to couples finding themselves being &#8220;romantically crowded&#8221;.<\/p>\n<p>&#8220;It is certainly true that in times of economic or social hardship, relationships can experience increasing levels of stress,&#8221; she said.<\/p>\n<p>Doyle also referenced reports from Wuhan in China &#8212; where the outbreak first started&#8211; which found there was a significant rise in separation and divorces among local couples after the imposed lockdown there was lifted.<\/p>\n<p>&#8220;Chinese officials claim that this social phenomenon was due to self-isolated couples spending too much time together. It is not yet clear if this will also be the trend in Australia,&#8221; Doyle said.<\/p>\n<p>&#8220;However, if someone is experiencing stress in their relationship as a result of the current climate, it is important that they seek expert advice.&#8221;<\/p>\n<h4>Thinking Differently\u00a0<\/h4>\n<p>Mullen said the current coronavirus climate has changed the landscape of family law in the country and put a strain on services with some court closures leading to limited ability for people to walk-in for advice.<\/p>\n<p>&#8220;Family lawyers are having to think differently about how they service these clients and I think that need that is coming to us from what clients want from us is more of that ongoing support,&#8221; she said.<\/p>\n<p>&#8220;Accessing services is difficult and not straightforward and information is not as easy to find.&#8221;<\/p>\n<p>Mullen said AF Legal was tailoring its own service to meet this changed demand by offering phone consultations with senior lawyers at a reduced rate.<\/p>\n<p>&#8220;I would like to see the family law profession follow suit and sort of try and help as many people through this as we can.&#8221;<\/p>\n<p>Doyle said Lander &amp; Rogers was adapting to the COVID-19 crisis by providing advice to clients via telephone, Skype, FaceTime and Microsoft Teams.<\/p>\n<p>&#8220;There has been an increase in the amount of telephone inquiries from new and old clients needing advice and reassurance about the implementation of their parenting or property matters; When people are stressed, it is harder for them to compromise,&#8217; she said.<\/p>\n<p>The most worrying trend was a massive increase in domestic violence as stress boiled over and partners could no longer escape the abuse.<\/p>\n<p>Australian Family Lawyers head of legal Courtney Mullen said 46 per cent of new cases in March involved domestic violence, up from the usual 20-30 per cent.<\/p>\n<p>&#8216;This can be attributed to more people spending time at home and the huge financial pressures behind the economic shutdown over coronavirus,&#8217; she said.<\/p>\n<p>Ms Mullen said the firm had 50 per cent more inquiries this year than the same period last year and they were &#8216;only just seeing the start of it&#8217;.\u00a0<\/p>\n<p>&#8216;We&#8217;re completely flat out, I&#8217;ve never seen anything like this,&#8217; she said.<\/p>\n<p>&#8216;Most of the calls I&#8217;m taking are families in crisis because of isolation\u2026 it&#8217;s just tragic.&#8217;<\/p>\n<p>AFL is receiving so many inquiries from Australians needing advice but struggling after losing their jobs that it has cut rates for initial consultations.<\/p>\n<p>However, this could be just the tip of the iceberg with cases expected to peak when lockdowns eased in the next few months.\u00a0<\/p>\n<p>&#8216;With people being stuck at home so much they don&#8217;t have the privacy to be able to speak with a lawyer without being under the watchful eye of their partner,&#8217; Rose Family Lawyers said.<\/p>\n<p>&#8216;They don&#8217;t like speaking about it in front of the children either and it&#8217;s hard to escape under the current circumstances.&#8217;<\/p>\n<p>Principal lawyer Phillip Gallo said the firm was preparing for an &#8216;unprecedented&#8217; influx when school resumed and social isolation was relaxed.<\/p>\n<p>&#8216;This is much like the annual post-Christmas spike, where we observe an increase in divorce-related enquires when children return to school,&#8217; he said.<\/p>\n<p>&#8216;Our clients generally want to confidentially discuss their situation when they are away from the family environment and out of earshot of their children and partner.<\/p>\n<p>&#8216;Unfortunately for many, the strict isolation protocols are contributing to the alarming increase in domestic violence within homes across Australia.\u00a0<\/p>\n<p>&#8216;With this in mind, divorce-related enquiries will likely surge once victims feel safe enough to take action.&#8217;<\/p>\n<p>Mr Gallo believed this time would show the true impact of coronavirus on family breakdown.\u00a0<\/p>\n<p>Melbourne Family Layers barrister Alison Loach said she expected even more calls when Australia&#8217;s economy finally improved enough for partners to leave.<\/p>\n<p>&#8216;A lot of people don&#8217;t separate until after the crisis is over. They think they won&#8217;t be able to sell the house, they&#8217;ve got no job or money to start again,&#8217; she said.<\/p>\n<p>&#8216;As soon as things start to get a little better, then they go.&#8217;<\/p>\n<p>Ms Reid said the government needed to step in and provide subsidies for couples counselling as part of its rescue package.<\/p>\n<p>&#8216;At the very least it may help some couples to move toward separation in a more cordial fashion. At best, it might help save some relationships,&#8217; she said.<\/p>\n<p>Divorce rates spiked by 4.7 per cent in 2009 and more in 2010 in the aftermath of the Global Financial Crisis, according to the Australian Bureau of Statistics.<\/p>\n<p>Couples must be separated for at least a year before they can apply for divorce, so the affects of coronavirus will be seen in 2021 and 2022 figures.<\/p>\n<p>However, the true breakdown will be higher as breakups of de-facto couples are not measured by official records.<\/p>\n<hr \/>\n<p>Original published on <a violence and practitioner obligations during COVID-19"},"content":{"rendered":"<p>There are evolving challenges facing practitioners who are seeing an increase in the number of new cases pertaining to family violence in the wake of the coronavirus pandemic.<\/p>\n<h4>Increases in violence in wake of COVID-19<\/h4>\n<p>Recently, Prime Minister Scott Morrison said that Google has seen \u201cthe highest magnitude of searches for domestic violence help that they have seen in the past five years with an increase of 75 per cent and [domestic, family and sexual] services are already reporting an increase in demand\u201d.<\/p>\n<p>Domestic Violence NSW spokesperson Renata Field added: \u201cServices are quickly adapting to ensure that help is accessible and safe during the COVID-19 crisis, however we are extremely concerned that people will be unsafe and feel that it is even harder than ever to reach out for help.\u201d<\/p>\n<p>Courtney Mullen, who is the head of family law in the ACT for Australian Family Lawyers, said there has been a \u201csteady increase\u201d since January of this year in her firm\u2019s file openings for matters involving allegations of family violence, \u201cto the point that almost half \u2013 around 46 per cent of the new cases we opened in March included some element of family violence\u201d.<\/p>\n<p>\u201cThere is definitely anecdotal evidence that the pressures of the lockdown on relationships and the financial strain from job losses and uncertainty are contributing factors. Social isolation practises requiring families to work and study from home in close quarters is a pressure cooker environment,\u201d she argued.<\/p>\n<p>There is discussion, she continued, amongst the family law profession about an increase in enquiries involving family violence.<\/p>\n<p>\u201cI speak to colleagues and they are reporting the same thing. We also saw evidence of this after the global financial crisis where there was a spike in divorces and relationship breakdowns. We know that arguments and pressure over financial problems are one of the main contributing factors in many divorces,\u201d she said.<\/p>\n<h4>Subsequent challenges facing family lawyers<\/h4>\n<p>Family law remains an exciting vocational path, both in spite and because of the challenges inherent in such practice, Coleman Greig principal and director Malcolm Gittoes-Caesar recently told Lawyers Weekly.<\/p>\n<p>What practitioners in this space must be aware of, however, is that fresh challenges are emerging as a result of the pandemic, Ms Mullen warned, saying that said challenges go beyond merely adjusting to working from home.<\/p>\n<p>\u201cSince social distancing was introduced, it has become apparent that new clients approaching us have a strong preference for seeing their lawyer (at least for the first time) in-person, rather than by phone or video link,\u201d she said.<\/p>\n<p>\u201cI think lawyers often underestimate the relationship of trust and confidence that is built with a lawyer-client relationship and I have observed this to almost require face-to-face meetings with some clients for that rapport to be built. This is particularly the case for vulnerable clients.\u201d<\/p>\n<p>Moreover, Ms Mullen continued, the impact on the courts of delaying lengthy or non-urgent hearings means that further delays are likely to be experienced well into the future.<\/p>\n<p>\u201cThis means that there is a growing uptake of dispute resolution processes. This also comes with its own challenges,\u201d she said.<\/p>\n<p>\u201cConducting mediations via video link has presented similar challenges; some mediators and practitioners aren\u2019t proficient using the technology, while clients continue to want to be present with their lawyers. There is something to be said for everyone being in a lawyer\u2019s office or boardroom for a negotiation, it adds gravitas to the situation and in my experience can help people reach agreement more quickly.\u201d<\/p>\n<p>This all said, with\u00a0technology being used across courts and judges differently, Ms Mullen mused, the messaging to family law practitioners has been \u201croutine and informative\u201d.<\/p>\n<p>\u201cThis has assisted us to understand how the process changes; not only for us but for our clients. There have certainly been challenges however, it is a whole new world,\u201d she noted.<\/p>\n<p>\u201cSome judges have asked for document exchanges only, while others are happy to speak over the phone or prefer to videoconference. At the moment you don\u2019t have to have court documents sworn and witnessed at the time of filing them which is a big change.\u201d<\/p>\n<p>When asked if a\u00a0lack of uniformity pertaining to parenting arrangements\u00a0has made it more difficult for practitioners \u2013 and whether it was contributing to increases in alleged family violence \u2013 Ms Mullen said that despite Family Court Chief Justice Will Alstergren\u2019s comments that\u00a0compliance with parenting orders may become \u201cvery difficult, if not impossible\u201d, she feels the federal government has \u201cactually been very clear on this by saying everyone must comply with parenting orders\u201d, and that coronavirus is no reason to breach those orders.\u00a0<\/p>\n<p>\u201cIt is the different lockdown restrictions and processes that apply to each state and territory that\u00a0[are] creating a degree of difference between the options and advice given to clients about what it\u2019s in a child\u2019s best interests,\u201d she advised.<\/p>\n<p>\u201cI think work is being done to try to make these restrictions more uniform, for example the states and territories all permit compliance with parenting orders if interstate travel is required to comply with those parenting arrangements.\u201d<\/p>\n<h4>How family lawyers can respond<\/h4>\n<p>As an industry, Ms Mullen submitted, \u201cwe need to be innovative\u201d.<\/p>\n<p>\u201cThe needs of our clients are evolving with the impact of COVID-19. Maybe a member of their family has lost their job and there is no income or there are allegations of family violence or concerns about children\u2019s health and wellbeing if a parent is exposed to multiple people in an essential services job,\u201d she said.<\/p>\n<p>\u201cWe have to be able to meet this increase in demand head-on. At AFL, are doing that by offering a limited retainer option for clients who have a budget of between $500-$1,500 in a staged assistance package.
